There are many states that are no fault auto insurance policy states, and New York is one of those states. If you are wondering what this means, basically, any vehicle owner who lives in the State of New York must carry a minimum amount of no fault insurance coverage.

Many people don’t really understand what this insurance is, or what it actually covers, but they get it because it is required. It is very important to understand everything about your insurance policy. When and if the time comes that you need to make a claim following an accident, the more you know about your coverage, the better prepared you will be.

Regulation 68 states that No Fault Benefits-Personal Injury Protection (PIP) covers the driver and passengers for the cost of all damages following an auto accident.

How No Fault Insurance Works in New York


What is No Fault Insurance Coverage?

No fault insurance is also referred to as 25/50/10 coverage. In a nutshell, this type of insurance will cover your expenses when you are in an accident, no matter who is at fault. In New York, drivers are required by law to carry a minimum amount of this coverage. The minimum coverage that all vehicle owners in New York must carry is:

  • $10,000 for property liability insurance
  • $25,000 for bodily injury to one person following an accident
  • $50,000 for bodily injury to more than one person following an accident
  • $50,000 in no fault coverage

No fault insurance pays for some, or even all, of your losses, no matter who is at fault in an accident. You can expect medical expenses and loss of income to be covered, up to the limits of your policy. You can access medical benefits immediately if you are in an accident, even if the accident is your own fault. Without no fault insurance coverage, you would have to wait until the insurance companies decided who was at fault for the accident before any benefits would be paid out.

When it comes to making insurance claims after accidents, there is a lot of stress involved, and it can get even more stressful when you have to deal with the other person’s insurance company. When you have no fault insurance coverage, you only deal with your own insurance company, which is going to take a lot of that stress away. When you don’t have to go after another insurance company to collect money for damages, you can save a lot of time and energy, and your stress level will be minimal, or at least as low as it can be in this type of situation.

For Residents of New York

If you are a resident of New York, your no fault insurance will provide coverage for expenses such as medical care and treatment of injuries that occurred as a result of an accident. It will also protect you if you are involved in a lawsuit for the pain and suffering of a victim who had non-serious injuries in an auto accident. No matter what insurance company you deal with in New York, you can be sure that they will be part of the no fault insurance program, and they will cover your medical bills in the event of an accident.

For Non-Residents of New York

As a rule, if someone who is not a resident of New York has an accident in that state, the only way his or her insurance is going to cover their expenses is if the insurance company is a national insurer that sells policies in New York or an insurer that takes part in the New York no fault car insurance program. In such cases, even if the driver does not carry no fault coverage, the insurer will still have to cover medical bills and other expenses resulting from an auto accident in New York.
